Court TV Host: In addition to being an entertainment lawyer and talk show host, Brad Pomerance also went to school with Robert Blake's older children. And he's here to talk to us about the case now.
Welcome, Brad!
Brad Pomerance: Thank you. I look forward to talking with all of you.
Question from: ctv_warhorse2: How did the DA come up with the laying in wait charge? What did Mr. Blake do to warrant that?
Brad Pomerance: I presume by getting out of the car and then returning to kill her, they view that as "lying in wait". If the allegations are true, this was not a crime of passion, where they got into a fight and in a fit of rage, and then he killed her. That would have warranted a second degree murder charge. This murder, as alleged, was premeditated, which warrants a first degree murder charge.
Question from: jgully: Were you friends with Blake's kids and were you at their house often, if so did you ever see Mr. Blake become violent?
Brad Pomerance: Noah and I were in the same grade. We were not best friends, but we were friends. I was at their house a few times, and I never saw Robert Blake act in a violent manner. He was a tough guy, but that's it. Deli was two years behind us. She was always very friendly, with a huge smile on her face at all times. Both Noah and Deli had great senses of humor and were generally well-liked.
Question from: golden_lover: Why did Robert Blake have his wife living behind his home and not in the same house with him?
Brad Pomerance: From what we hear, Robert Blake did not feel necessarily loving toward Bonny Lee. It is safe to say that they would never have gotten married if she did not get pregnant with Rosie. He has said he only married her because of Rosie. So it is not surprising that they were living in separate quarters in the residence.
Question from: ripley51: Mr.Pomerance, the private detective Scott Ross said that there had been a man in his early 20's who had a crewcut, who would watch Blake's Studio City home from a black four-door pickup. Do you know if there was any follow-up on this man?
Brad Pomerance: Only Blake and Caldwell have been charged - after 11 months. So the DA must have determined that charges could not be brought against others. And remember, Jon Solari, who was just on Crier Live, said he would have killed her - so I have to think they investigated every possible conspirator and only came up with Caldwell.
Question from: gage: Has Blake ever been under psychiatric treatment?
Brad Pomerance: He has said publicly that he has suffered with depression. We do not know if he sought intervention from a psychologist or psychiatrist. I am sure we will hear about his mental state when the trial begins.
Question from: Doris-CTV: Who is taking care of the baby?
Question from: momof3: Who has custody of Rose now?
The older children?
Brad Pomerance: Deli Blake, his adult daughter, is caring for the baby. There have been questions about whether Marjerry, Bonny Lee's sister, would seek custody, and she said yesterday that she would not. Let's see if she sticks with that view.
Question from: JustCurious: Why did Mr. Blake park that car around the corner of the restaurant?
Brad Pomerance: Jon Solari told me before the taping of Crier that Blake always packed his car far from restaurants.
Question from: tinkerbelle: Do you believe Robert Blake to be guilty? Brad Pomerance: All we have now is the criminal complaint, so it's hard to say. I will say that the LA Police and DA's office are surely "gun shy" after the OJ fiasco. So I am sure that they believe that they have a very strong case. Based upon the criminal complaint, I have to say that Harlan Braun, Blake's lawyer, has quite a challenge before him. Remember that they took 11 months before they charged - so they crossed all their t's and dotted all their i's.
Question from: Justice: When was the last time you have had contact with the Blake family?
Brad Pomerance: I saw Noah at our high school reunion.
Question from: MLG: Has Mr. Blake had any history of violence towards other women with whom he's had relationships?
Brad Pomerance: I do not believe he has ever been accused or charged with domestic violence.
Question from: boop: Is Mr. Blake a man who is used to getting his own way?
Brad Pomerance: Blake has claimed that he was abused as a child by his father. He always was reputed to have been very difficult on the set of Baretta. And many believe that the show was canceled prematurely because of his difficult nature on the set. He has not had the most stellar career since Baretta - so I really wonder whether he believes he has gotten his "own" way in life.
Question from: ctv_warhorse2: How did Mr. Blake meet Bonnie? Brad Pomerance: Harlan Braun has said that he met Bonny at a jazz club and that they conceived Rosie in the back of that jazz club.
Question from: faith: Was Robert Blake as "dark" sided personality-wise as he appears in the media?
Brad Pomerance: His Baretta personality apparently is not far from his real persona, but I remember his children feeling very strongly toward him.
Question from: deputydi: I read somewhere that his story about returning to the restaurant to retrieve his gun was made up. He actually shot her as soon as they returned to the car.
Question from: gage: Do you think he had his gun in the restaurant waiting, then left her to go get it?
Brad Pomerance: The exact timing can not be pinned down that precisely, but we do know that no patron at Vitello's was able to testify that he left with a gun.
Question from: justiceone: Being that he is approaching 70, how much sense would it make to impose the death penalty, if applicable?
Brad Pomerance: You make a good point, but if he did commit this act as described in the complaint, it qualifies as a classic first degree murder. And I wonder how the prosecution could not seek the death penalty - other than for the obvious reason: he is a celebrity.
Question from: ctv_warhorse2: What is the general feeling of the public in LA about this?
Question from: Voege5: Do you believe it's going to be another circus, like the OJ trial?
Brad Pomerance: Shell-shock, especially in Hidden Hills, which is right near where I grew up, and my parents said it was chaos yesterday. I have a friend who lives nine houses from him, and she said it was surreal. I think that the judge will do everything to avoid a circus like OJ - but I will go on the record and say, I fully support Court TV's decision to seek cameras in the courtroom.
Court TV Host: Thank you very much for being our guest today.
