Court TV Host: Diane Dimond is here! Welcome, Diane...thanks for coming back again today!
Diane Dimond: Hello, everyone - anyone have a Michael Jackson related question? Before we start let me say the third part of my thee-part series on THE SETTLEMENT OF MICHAEL JACKSON airs in about an hour on CTV's Catherine Crier Live. Tonight I'll reveal, not my confidential sources, but the genesis of the document.
Question from christy: How did you get the info for Jackson?
Diane Dimond: Well, I can't say who ANY of my confidential sources are....
Question from JudgeGuilty: Hi Diane, have you heard from the Michael camp personally??
Question from kali: Diane, have you heard anything from the MJ family about their reaction to the news yesterday?
Diane Dimond: I've heard they are saying the document I'm showing is not authentic but I can assure you it IS authentic. It is a copy of the FINAL FINANCIAL SETTLEMENT between Jackson and the first accuser. They are also spreading the word that I paid "big bucks" to get it. That is a lie. I paid nothing. Court TV does not allow us to pay for anything.
Question from chromo: Why were eight pages from the settlement agreement missing and will those be published one day?
Diane Dimond: You will learn on tonight's Catherine Crier Live (or later on our web site) that the 8 pages were allowed to be redacted by a Judge who ordered a copy of the settlement be given to..... are you ready for this???? ....to his then wife, Lisa Marie Presley. The judge ruled that since she was getting sued for speaking out about the case (along with Jackson himself) on that Diane Sawyer ABC special she should get to see the settlement she was accused of breaking. But the judge also ordered that the pages spelling out where the money came from and how it would be disbursed could be edited out. Whichever Jackson lawyer handed Lisa Marie's lawyer that "redacted version" forgot to black out the final trust fund figure.....15,331,250.00 oooops!
Question from doogy: What had she said?
Diane Dimond: 17 months after Jackson signed the settlement, promising to forever keep silent about the case, he went on the ABC special, and both he and Lisa Marie said (and you'll see it tonight) there was nothing to the case, that it was all lies, etc. The little boy's family sued MJ, Lisa Marie, Diane Sawyer and ABC.... because no one was supposed to say ANYTHING about the case - ever.
Question from Incognito: Do you know how that amount was arrived at?
Diane Dimond: No -- but the figure $15,331,250.00 makes me think there was a lot of complicated math behind it. I figure they tried to come up with a figure that over the course of the pay-out plan would equal 20 or 25 million dollars. Given fluctuating interest rates I don't know HOW they'd know that...but that's just my guess.
Question from WildCat: Diane, can you or CTV be sued for airing this?
Question from doogy: Will you be sued now that you have spoken out?
Question from Angel: Hi Diane, could you be sued for releasing confident information?
Diane Dimond: We don't think we've done anything wrong. But of course anyone can sue anybody over anything, right?
Court TV Host: What was the final result of the ABC suit?
Diane Dimond: The judge in the case split the case; the part against Jackson was sent to secret arbitration, as the settlement mandated. The other part against ABC, Diane Sawyer, etc. was ultimately thrown out of court.
Question from Oreo: Diane: What a shocker. Where did Johnny Cochran come in on this settlement?
Diane Dimond: Jackson first started his defense with an attorney named Bert Fields. Then Howard Weitzman joined the team. After Jackson fired Fields, Johnny Cochran joined Weitzman and as you can see on the documents (see our web site) their signatures are on page 31 of the final settlement, right under Michael Jackson's...
Question from Angel: Hi Diane, Carol Davis said you should be ashamed for releasing confidential information, what is your reaction?
Diane Dimond: I don't know who Carol Davis is. But I am in the business of revealing the truth. And the document I showed you is the truth.
Question from Incognito: Did the accuser have to pay income tax on the money he received?
Diane Dimond: No. because it was awarded for, in effect, "pain and suffering" all the money is tax-free. Boy, these are smart questions!
Question from nat: Diane, are you worried about your personal safety and do you have a bodyguard?
Diane Dimond: Sometimes. And, sometimes.
Question from ccarston: Have you ever looked into the possibility that Evan Chandler was blackmailing Michael Jackson?
Diane Dimond: Well, of course!!! That was the allegation way back in 1993....so all of us reporters worked that angle HARD. Interesting to note in the final settlement, and at Johnnie Cochran's news conference announcing there was a "resolution to the case, "it was announced that Jackson had DROPPED all his claims of extortion.
Question from doogy: Diane, weren't you sued by Jackson sometime ago?
Diane Dimond: Oh, yes. Back in 1994. He sued me and the TV show I worked for (Hard Copy) for 100 million dollars. A judge dismissed the case (summary judgment) against me.
Question from chromo: Why does Larry Feldman not want to investigate the leak of the settlement agreement or the leak of Jordan's affidavit but wants to have the leak of the DCSF memo investigated?
Diane Dimond: Oh, I think he DOES want to have it investigated.... but which government agency would do that? There is a process in place to investigate DCSF wrongdoing and it's through the County Board of Supervisors....that's the route Feldman took on behalf of this second accuser. But where would he go to investigate this?
Question from JohnMark: Can the prior settlements regarding MJ's alleged abuse be used against him in the upcoming trial?
Question from Oreo: Diane: Do you think the latest on Michael will be used in upcoming trial?
Question from Ando: How likely is it that the 1993 charge of child molestation will be used against Michael?
Diane Dimond: Well, the settlement I revealed this week COULD make it into court on this pending criminal matter. Especially if the first boy (now 24 years old) comes in to testify. But even if he doesn't appear I suppose the DA might be able to try to introduce it in court to show a "pattern of behavior" by Jackson. I'd have to research that.
Question from kiara: Diane, what is the status of that attorney MJ's dad hired to help MJ?
Diane Dimond: I assume your talking about Debra Opri. She's an L.A. based attorney who Joe Jackson hired to help HIM and the rest of the family understand what's going on in court. Jackson's defense attorney, Tom Mesereau, needs to concentrate on the defense and doesn't have time to sit and explain it all to Jackson's parents. I spoke to Ms. Opri yesterday and she plans on being in court for the next hearing (as will I) on June 25th.
Question from kiara: Diane, does it seem like Mesereau is working well with mj and the jacksons?
Diane Dimond: Tom Mesereau is a brilliant defense attorney. I imagine his challenge now is trying to learn everything he can about all the players, all the details in the case before next Friday's hearing. At that time there will be a 955 motion argued. In other words Mesereau will stand before the judge and argue why he and Jackson think the indictment should be dismissed. That rarely works, but it will be interesting to see if Mesereau wins!
Question from drenda: Do you think DA Sneddon's release of Jackson's driver's license number and CII number was intentional?
Diane Dimond: That's standard operating procedure (the DL release) but I have to admit I don't know what a CII number is?
Question from ccarston: Since you have sources "inside the SBDA's office" why did you NOT report about their PRIOR investigation where they concluded nothing happened?
Diane Dimond: I did report it the minute I could confirm it. And I'm not admitting where I might have sources, by the way. A couple more questions....then I have to run.
Question from Anxious: Diane - If you were allowed to ask MJ one question what would you ask him?
Diane Dimond: Why are you so unhappy with yourself?
Court TV Host: Any closing thoughts?
Diane Dimond: The trial of Michael Jackson is tentatively set for mid-August, although I'm not convinced it will really start then. If I had to guess though I'd say they'll probably be picking a jury by early October. That could take a month or so! Thanks for all your questions.....Diane
Court TV Host: Thank you, Diane, for joining us today! We'll see you on Crier in just a few minutes!
