Court TV Host:We are being joined by Carole Gareau-Rasco, one of the alternate jurors in the Cody Posey trial.
Court TV Host: As you may remember, she is, interestingly, a psychologist who has worked with abused children.
Court TV Host: Welcome, Carole Gareau-Rasco, thank you for being our guest online today.
Carole Gareau-Rasco Hi, I'm glad to be here, to be part of this. I'm disappointed, after sitting through all this testimony, I'm disappointed and a little confused, at the verdicts being across the board, three different situations, and would wonder how that came to be. I personally would have probably tried to vote manslaughter across the board.
Question from snuffy: Carole, as you've heard and read more and more, any new thoughts about what you've heard and have you modified any of your opinions?
Carole Gareau-Rasco Basically, I would have to say that my opinions as to abuse have been increased, as to the validity of it. I have suspicions as to the incestuous involvement as to Marilea with the father and the mother. I think there's a lot of stronger information that we didn't hear about, and coming from a mental health background, I had suspected that there were probably some incestuous relationships. And I would expect there's more to that night that possibly could have involved the sister that we have not been told about or found out about. And I think that may come out in the future as Cody gets further into his therapy.
Question from Deano: Hi Carole , did you feel pressed by the media?
Carole Gareau-Rasco I really saw no media coverage before or during the trial, and to my knowledge we all complied with it. I know I did. So it couldn't influence us, until I left the jury room as an alternate.
Question from LawFilly: Carole, how did you feel about the prosecutor?
Carole Gareau-Rasco The prosecutor's style was somewhat offensive to all the jurors. Or most of them. Actually, there were comments being made almost in our face as jurors, and facial expressions that were kind of contrary to what Mitchell would be presenting, and I'm sure that was being done deliberately, and there were other jurors who commented on that. We sent two notes, one at the beginning and one at the last few days of the trial, to the judge about conversations we overheard, but I think he mistook it for being the gallery as opposed to the prosecution table.
Question from Laurie: Carole, did most everyone on that jury believe in poor Cody's abuse?
Carole Gareau-Rasco I think most everyone bought the abuse, yeah. But I also believe that there were three or four who felt that they dealt with similar situations as children, and because they dealt with it, he should be able to deal with it.
Question from AnnaAgain: Do you feel that the jurors failed to recognize Cody Posey as a child?
Carole Gareau-Rasco I think that was a possibility for some, because of his image as a child. It's hard to look back and see a skinny little fifteen year old, when you see this man -- well, not a man, because his mannerisms are definitely that of a child. The other issue of concern is that the jurors aren't told of the possibility that he could be sentenced to life in prison with a conviction of murder one. And I think that if that was a fact that was known, things might have gone a little differently.
Question from mlb: Were you surprised by the verdict? Would it have been different if you were on the jury?
Question from Deano: Hi Carole would you have held out?
Carole Gareau-Rasco First, I was surprised at the verdict, because I thought the verdicts would all be the same. Second, it is my thought that with all the testimony I saw, and if the law and instructions were as I recall them, I would have voted for manslaughter across the board. I WOULD have held out and voted for manslaughter -- if it was within the legal guidelines. There's a little side note to these concerns: Crystol and I were the only jurors who sent notes to the judge asking questions concerning the prosecution's case. One was the validity of the psychiatrist sent by Chrystol. And I sent a question -- after the information about the computer-- I sent the question about whether there had been any physical evidence about incestuous abuse regarding Marilea by the father. And I never got that question answered. And that day, I learned now, the prosecutor went ballistic, and tried to have me removed from the jury panel then.
Question from Laurie: Maybe that is why you weren't but an alternate. They didn't want you to be on that jury. The prosecutors that is!
Court TV Host: Do you know how it was determined who was to be an alternate?
Carole Gareau-Rasco No, but both of us are going to investigate that fact because we have a strong concern about it.
Question from solidgoldangel: Carole, why do you believe the jury is not talking?
Carole Gareau-Rasco This is just my opinion: I think there must have been a lot of differences and the compromises have people concerned.
Question from Alison: Carole, with your background, were you concerned that you would be excluded from the jury selection initially?
Carole Gareau-Rasco Yes, they questioned me in great detail during jury selection.
Question from Janeygirl: Is there anything you plan to do to support Cody now that the trial is over?
Carole Gareau-Rasco I've offered any assistance to Mr. Mitchell's office that he would need, and I will write and encourage others, and anyone in this webchat to write to the judge to ask him to sentence Cody as a juvenile and not as an adult.
Question from Terri: I don't the jury took enough time to think about the decision they were making, what do you think?
Carole Gareau-Rasco I agree. Some of these jurors didn't take any notes at all, And I can't believe that they deliberated in the small amount of time that they did.
Question from dmk: Would you be a witness for Cody at his sentencing hearing?
Carole Gareau-Rasco Very definitely.
Court TV Host: Any closing thoughts?
Carole Gareau-Rasco I would just say to people: be an advocate for abused children that slipped through the system every day of our life -- keep our kids safe! I have to go now...
