Susan Polk Murder Trial
  Courttv.com's Lisa Sweetingham reports
March 2, 2006

Court TV Host: Welcome, Lisa, thanks for being our guest. What's the latest?

Lisa Sweetingham: Hi, thanks for having me. It's been an interesting morning. Scott Dyleski, the alleged killer of attorney Daniel Horowitz's wife, was arraigned in a courtroom one floor above Susan Polk's, where she is now in her fourth day of jury selection. Dyleski pleaded not guilty, and his trial is set for July 17. Meanwhile, opening statements may begin as early as Monday in Polk's trial, where she is defending herself.

Question from NH-JULIE: Lisa, do the children concur that their mother was abused by the victim?

Lisa Sweetingham: The children are torn apart by this case. Two of them, Gabriel and Adam, have opposed their mother. If you watch any of the exclusive videotape that we have on the site, Gabriel wished the death penalty upon his mother immediately after discovering his father's body. However, Eli has stuck by his mother, is going to testify in her defense, and brings her clothing in the morning for trial. Details of any alleged abuse will come out in the weeks to come when Gabriel and Eli take the stand.

Question from NH-JULIE: Hello Lisa :)) Why did Susan Polk fire her attorney? What was her exact reason?

Lisa Sweetingham: Susan Polk has gone through four attorneys before defending herself. The reason she gave for firing Daniel Horowitz was that her wife's killing was too distracting and that he hadn't been spending time on her case. She may have private reasons that she's not willing to publicly divulge, but Horowitz has said that he thought that Susan really wanted to defend herself all along, and that he wishes her the best. Horowitz's non-lawyer assistant Valerie Harris has been hired by Susan Polk to aid her in her defense. She has told me that she has discussed coming to Polk's aid with Horowitz and that he was gracious about it. I don't believe that Harris had a staff position with Horowitz, but worked with him on a case by case basis, This, Susan Polk's case, was a job that presented itself, and so she took it.

Question from Cosmo: How often does Polk cry ? In front of jurors ?

Lisa Sweetingham: I've seen her break down before the jurors once at the end of the day, but she quickly composes herself, brushes away the tears and gets back to questioning. While she has a unique voice and is thin and frail looking, I think she knows exactly what she wants, and she isn't afraid to argue her case, although jurors have repeatedly said that they feel her decision to go pro per makes them uncomfortable. Any juror who has said they can't fairly judge the case and evidence presented because of her pro per status has been dismissed.

Question from Anxious: Lisa, is Susan Polk capable of defending herself? Does she have any legal training?

Lisa Sweetingham: She's not legally trained. It's her right and her choice to defend herself. She's clearly at a disadvantage. For instance, she admitted that she only learned this week that a jury must reach a unanimous verdict, or else it's a hung jury.

Question from ally: Are law books supplied to Susan Polk daily? If so are they up to date on laws?

Lisa Sweetingham: She has a jury consultant for the jury selection process. She has access to law books. At one point she read aloud from a jury instruction regarding evidence -- and she's very articulate, and she's proceeding with questioning as perhaps a first year law student might, meaning, she asks the right questions, but she might make mistakes here and there. Some of her questions might present too much evidence, and the judge will have to stop her to say, no pre-trying of the case. She's doing much better than I expected, but several of the jurors have complained about how slow she is and how protracted her questioning is. In the first trial, the judge said it would be about six weeks. This time, she announced, it might be two and a half months. I've got to run. Thanks for joining me.
