HENRY PYLA, being first duly sworn, deposes and says:

1. That I have been employed in law enforcement for over forty (40) years, and as such I am competent to testify to the matters set forth herein.

2. For the last five years, I have been employed as a bailiff with Department Six of the Eighth Judicial District Court, for the County of Clark, where the Hon. Judge Joseph Bonaventure presides.

3. In the course of my regular employment as bailiff, I was charged with responsibility over the jury in the case styled State of Nevada vs. Richard Bennett Tabish and Sandra Renee Murphy. As such, I met the jury in the mornings before trial and accompanied them at all times during the trial. I was also charged with the responsibility of maintaining the jury during all deliberations in both the guilt phase and the penalty phase of the trial. As such, I am the only member of court personnel to have contact with jury members during deliberations.

4. During deliberations in the guilt phase, the foreman of the jury requested that photocopies be made of certain of the Jury Instructions provided by the Court, so that each member of the deliberating jury could have their own copy in the jury room. I passed that request on to Judge Bonaventure, who granted the request. The jury foreman then gave me certain instructions to photocopy, and the photocopies were returned to the foreman.

5. I have been made aware that it has been alleged that I provided some information on the law of murder or robbery to the jury foreman during deliberations in the guilt phase. That allegation is false. At no time did I ever provide any information on the law to any member of the jury.
