ARTICLE 3. OFFENSES AGAINST THE PERSON

18-3-402. Sexual assault.

(1) Any actor who knowingly inflicts sexual intrusion or sexual penetration on a victim commits sexual assault if:
(a) The actor causes submission of the victim by means of sufficient consequence reasonably calculated to cause submission against the victim's will

(4) Sexual assault is a class 3 felony if it is attended by any one or more of the following circumstances:
(a) The actor causes submission of the victim through the actual application of physical force or physical violence






    NBA star Kobe Bryant was accused of sexually assaulting a 19-year-old hotel concierge in Edwards, Colo. The case against Bryant was dropped by prosecutors during jury selection after the accuser refused to testify.

    'Attention Seeking'
The defense filed this motion in an effort to admit alleged evidence to show the accuser is an 'attention seeker.'
Trial Order
Following a preliminary hearing, a judge ruled there was enough evidence to send Kobe Bryant to trial.

In reaction to the charges, Kobe Bryant's lawyers released this statement to the media proclaiming their client's innocence.

The defense requests a hearing regarding the extensive pre-trial publicity surrounding their famous client.
Complaint
This document charges Bryant with a single count of sexual assault, which could carry a penalty of four years to life if he's convicted.
Sheriff's Release
The Eagle County Sheriff's Office issued this brief statement, which describes Bryant as "cooperative."
Appearance Motion
The defense requested Bryant be excused from his Aug. 6 court apperance; though prosecutors didn't oppose, the judge denied the motion.

Prosecutors asked the court to seal all affidavits and other records, and the judge granted the request with a handwritten order.
