Jury selection finishes in Carruth capital murder trial

CHARLOTTE, N.C. (Court TV) — The search for jurors in the capital murder trial of former Carolina Panther Rae Carruth ended Tuesday as attorneys chose the last of four alternates.

Judge Charles Lamm is expected to announce on Wednesday whether opening statements will begin Thursday or Monday.

Following the selection of the fourth and final juror, a white woman, attorneys argued pre-trial motions which Lamm will need to rule on before testimony can begin.

Chief among those issues is a pregnancy journal kept by Cherica Adams before she was gunned down in a drive-by shooting on November 16, 1999.

Adams gave birth to Carruth's son, Chancellor, by an emergency Caesarean section, but died of her injuries a month later.

Written statements show Adams did not fear Carruth, and that while she acknowledged Carruth didn't want to pursue their relationship seriously, she believed he would make a good father.

Lamm must rule whether the journal is considered hearsay and therefore, inadmissible.

Prosecutors believe that the journal shows Adams trusted Carruth, making her more vunerable prey.

But defense attorney David Rudolf argued that if anything, the journal shows Carruth had no motive to orchestrate Adams' murder.

Jury selection, which lasted more than three weeks, resulted in a panel of seven white men, two white women and three black women. Also selected were four alternates, a black male and three white females.
