After lengthy delay, teacher-student sex trial to start in November

Beth Friedman faces up to 76 years in prison for having a sexual relationship with her student.

A Florida schoolteacher accused of having a sexual relationship with her 15-year-old student could face up to 76 years in prison — that is, if the case ever makes it into a courtroom

Since she was first arrested in August 1999 for allegedly having an 18-month affair with Donald Vaden, then 15, Friedman, 42, has resigned from her teaching job at Silver Lakes Middle School, dropped 45 pounds due to depression and anxiety, and checked herself into a mental hospital for psychiatric treatment.

And, because of heart surgery for her lawyer, David Bogenschutz, her trial was moved back an additional two months. Currently, the trial is scheduled to resume on November 26 with the selection of a new jury. Meanwhile, Friedman is free on bail.

Friedman was charged with three counts of indecent assault, two counts of unlawful sexual activity with a minor and one count of contributing to the delinquency of a minor, all of which could land her in jail for a total of 76 years.

Police said Friedman lured Vaden into a sexual relationship by boosting him up a grade in school and giving him clothes, drugs, money, jewelry and even a car.

The defense claims that Friedman was the victim of a scheming, law-breaking youngster. Friedman has denied having a sexual relationship with Vaden, saying that he threatened to turn her in on trumped-up charges unless she continued to supply him with gifts and money.

During the trial, Vaden is expected to detail the incentives that Friedman offered him for sex, and which he willingly accepted.

"She was like, if I have sex with her, I'll give you a car," Vaden said in the deposition. "I thought it was a good deal. What would you think about that?"

Vaden also told police that Friedman offered him $25,000 to impregnate her. Expecting the cash, Vaden told his parents and they notified police.

Vaden also said that Friedman funded his marijuana habit and, later in the relationship, paid for cocaine the two shared.

Darius Vaden, Donald Vaden's younger brother, is also expected to testify.

In his deposition, Darius Vaden said that he knew his brother was having sex with the teacher "by the way they acted ... She would always be all over him laughing."

Darius Vaden may give the jury insight into what it was like for the family to live with Friedman, who took them in when they needed lodging.
