Florida abortion doctor sentenced to 3 years, 10 months for extortion  
   

OCALA, Fla. (AP) — An abortion doctor was sentenced Thursday to three years and 10 months in prison for trying to extort at least a $1 million after accusing a county official of making bomb threats.

Dr. James Scott Pendergraft, 43, also was sentenced to two years probation and ordered to pay a $25,000 fine. His accomplice and real estate adviser, Michael Spielvogel, received a three-year, five-month prison sentence, followed by three years of probation but was not fined.

Both men remain free pending their appeal.

A jury in February convicted both of attempted extortion, conspiracy and mail fraud. Spielvogel, 54, was also convicted of lying to the FBI and filing a false statement.

Prosecutors said the defendants lied in affidavits in an effort to extort a big settlement from Marion County for dropping a lawsuit that alleged the county and city of Ocala didn't allow off-duty police officers to moonlight at Pendergraft's clinic.

Prosecutors said Spielvogel claimed county Commissioner Larry Cretul threatened him in a telephone call by saying it was not a matter of "if" but "when" Pendergraft's clinic would be bombed. Spielvogel later admitted he made up the remarks.

During a meeting with a county attorney to settle the lawsuit, Pendergraft threatened to bankrupt the county by seeking $100 million in damages. The meeting was secretly taped by the FBI.

Pendergraft's attorneys said the threat was rhetorical. The judge said he didn't think the defendants meant to extort more than $1 million.

Ocala is about 50 miles northwest of Orlando.
