He was also indicted on three counts in the death of advertising executive Thomas Mosser by a grand jury in Newark, New Jersey. He will be tried separately on those counts. The following are counts for the Sacramento trial. Both counts Eight and Nine are eligible under federal statute for the death penalty. Though the charges in those counts are repeated in other counts, the alleged crime occurred after the 1994 crime bill was passed by Congress.
