with CourtTV's Clara Tuma about today's developments in the Zamora

Jon Bonné: Hi everyone. I'm Jon Bonne, the senior editor of Court
TV Online, and I'll be along for the ride this evening. Clara will be here
in just a few minutes, so make sure to get those questions in.
Jon Bonné: For those of you who couldn't watch the trial today,
*boy* was it a busy day.
Jon Bonné boggles at the concept.
Jon Bonné: Diane Zamora, who was convicted in February of capital
murder in Adrianne Jones' death, was brought to court today from prison. But
when put on the stand, she took the Fifth and wouldn't testify.
Jon Bonné: Zamora was brought to court outside of the presence of
the jury.
Jon Bonné: Prosecutors argued that Zamora gave up her right to
plead the Fifth when she testified in her own trial. Judge Leonard disagreed.
Jon Bonné: But he ruled that, since she wanted to plead the Fifth,
she was unavailable for testimony.
Jon Bonné: But perhaps the biggest event of the day: the defense
rested without presenting a case.
Jon Bonné: I think Clara has just arrived. Clara, are you there?
Jon Bonné: Sorry, Clara is moments from being here. Keep sending
in your questions, she'll arrive any moment!
Jon Bonné: Back to the trial for a moment... Zamora reportedly
mouthed the words "I love you" to her family while on the stand.
Clara Tuma: Hi y'all.
Jon Bonné: Clara has just arrived. Welcome, Clara! Let's take the
first question.
Daffy831698 asks: Hi, why couldn't Diane say the same thing today
that she said in her trial?
Clara Tuma: She could have, but she chose not to. plus the defense
would have tried to massacre her on cross-examination.
Codeblue256 asks: What of Joseph? The other friend of Graham 's that
was mentioned by Green in the trail today, it is rumored that he has a lot
more to do with the case.
Clara Tuma: Neither side pursued that, but I've wondered that for
months myself.
Clara Tuma: If that part of the confession is true, I think the
state would have wanted to bring it in.
Clara Tuma: And if it is not true, the defense would have loved it
because it would have been yet another inconsistency in Graham's confession.
GHKimmy asks: Hi Clara! I missed the some of the coverage of the
trial so I'm not sure whether or not Jay Gould testified in this trial. Did
he? If not, why not? Also, I'm not sure I understand the legal reason why
the prosecution did not introduce Diane Zamara'...
Clara Tuma: Jay Gould did not testify because most of what he knew
were things that Diane told him that she had done. And the only statements
from her that were admissible were things that she said that she and David
did together.
SAS_78201 asks: Did Adrianne tell anyone that she had an tryst with
Graham?
Clara Tuma: Great Question! But no one has been able to find
anyone that says she did.
Jon Bonné: Terrific questions -- keep ' them coming!
Clara Tuma: There has been a lot of talk about sixteen year old
girls and whether it would be normal or abnormal to keep a tryst to
themselves
Delene_79 asks: I understand that David's attorney did not want to
make the same mistake that Diane's did by putting her on the stand, how is
he going to sucessfully argue the facts that he was unable to prove through
direct testimony.
Clara Tuma: By relying on reasonable doubt, the presumption of
innocence, and the facts that he brought out in cross examination.
Dana188 asks: Why did Wendy Bartlett testify that she was a senior
when Adrianne was a sophomore? David and Diane would have been out of
school when the murder occured. I thought they were seniors and Adrianne
was a sophomore at the time of the murder.
Clara Tuma: Yea, it struck me as odd too, because that bit of
testimony could not have been correct but neither side pursued it.
Maybegirl asks: that letter to John Green was really damsging what
did you think
Clara Tuma: I thought it was damaging but not necessarily
incriminating.
Clara Tuma: Because he mentioned being forgiven for sins, but he
never mentions a specific sin such as murder.
GHKimmy asks: Clara I also want to know if you think the one juror
that is on the panel that is very religious will present a problem for the
prosecution? I'm worried that she might. Isn't it true that only one
person has to believe that there is reasonable doubt ...
Clara Tuma: That is a great question and one that the lawyers have
been discussing all afternoon. During jury selection, that juror said she
could not judge antother human being because of her religion. She backed
away from that when she was questioned about it. But she was clearly paying
attention when that letter was introduced today.
Cookie_2 asks: Clara, will there be a follow-up on the Reco Jones
story? You were great in Detroit! I've become a CourtTV junky since that
trial
Clara Tuma laughs hysterically.
Clara Tuma: Thanks so much, but I don't think we'll do a follow up
because Rico will be spending the rest of his life prison.
Clara Tuma: It's funny you should mention that case because that's
the last time I was in court when someone claimed a fifth amendment
privilege.
Jon Bonné: Keep sending in these questions -- they're great!

Clara Tuma: Why do you ask? It's embarassing. I take the fifth.
Clara Tuma laughs hysterically.
Thomthom1968 asks: Why not a plea bargain
Clara Tuma: There was a plea offer to both Diane and David. But it
was for the maximum sentence for murder which is life in prison with a
thrity year minimum. Which neither Diane or David thought was a bargain.
SAS_78201 asks: What do Adrianne Jones parent's believe happened?
Clara Tuma: I've not talked to them specificall about that, but we
know they have supported the prosecution the whole way.
Clara Tuma: And we know that they have been steadfast since the
beginning in their belief that Adrienne never slept with David Graham.
DeltaDalta7 asks: what was the ranks of the two cadets
Clara Tuma: Diane was a midshpmen and David was a cadet fourth
class.
