PLYMOUTH, Mass. (Court TV) — Undeterred by the mistrial that left his client in legal limbo, Lindsay Clancy’s attorney, Kevin Reddington, had a simple message for Plymouth County District Attorney Timothy Cruz: “You, Tim, were crushed.”

Reddington maintained that the mistrial was a legal victory after the jury foreperson reported in a note to the court that the panel was deadlocked 11-1. The lone holdout refused to budge, despite the judge’s instructions to apply the law regarding reasonable doubt.
Clancy, 36, stood trial on charges that she murdered her three young children. She admitted to strangling Cora, 5, Dawson, 3, and Callan, 8 months, at her family’s home on Jan. 24, 2023, but claimed that she was in the throes of a mental health crisis brought on by postpartum psychosis.
The trial gained widespread media attention over its seven-week run. Thousands of people who watched the trial voiced their support for the defendant, believing that she was psychotic at the time of her children’s deaths.
Asked about the attention on the case after the mistrial, Cruz said that the focus should be on the children. “We’re at this courthouse today because those children are not,” he said. “Our priority has always been to fight for Cora, for Dawson, and for Callan. The noise in this case may be louder than it is for other prosecutions in our county, but we have treated it the same as any other case. Children were murdered, and it’s our job to seek justice. I appreciate the fact that there are strong feelings and opinions tied to this case; however, our job is to set aside our feelings and focus solely on the facts. The facts are Lindsay Clancy killed her three children and the evidence suggested to us that she was in control of her actions when she committed those homicides.”

Some of Clancy’s supporters began to shout at Cruz, yelling, “You only cared when the kids were dead? Why don’t you care about the mother?”
“You know, I’m not going to stand out here and listen to this,” Cruz said.
“Cruz knows that he was crushed. He doesn’t have a case,” Reddington said after leaving the courthouse. “You don’t stand here at a bunch of microphones and crow about your victory. Because you, Tim, were crushed, as you well should have been.” Reddington offered the DA advice about hiring experts ahead of the presumed retrial: “I think Mr. Cruz should revisit his facts and see whether or not he can even prove the case before he worried about whether or not they can bring those hired guns in. I wouldn’t even call them hired guns. Hired water pistols.”
When asked how Clancy and her parents were doing after the mistrial, Reddington said simply, “Not good. … They know that they were robbed by one man, for whatever his agenda was, who stole seven weeks of the lives of these other jurors who were so attentive.”
In a statement following the mistrial, Patrick Clancy, Lindsay Clancy’s ex-husband and father of the children, said, “Patrick Clancy is grateful to the Court and to the jurors for their hard work, their commitment, and their perseverance. The loss of Patrick’s children is something from which he will never recover and from which there will never be closure. The prospect of reliving this tragedy through another trial is extraordinarily painful.”
